2. Scope

These terms apply to every offer, order and agreement through our online store. Any deviation is valid only when confirmed by us in writing. All mandatory consumer rights remain fully applicable.

3. Offers, product information and prices

We describe our products as carefully as possible. Images, colours and technical drawings may differ slightly from the delivered product where this does not affect essential characteristics. Obvious errors, typographical mistakes and clearly incorrect prices are not binding.

Prices are shown for the selected market and currency. For consumers in the European Union, prices include applicable VAT unless expressly stated otherwise. Shipping charges, import duties, local taxes and other costs are shown or clearly explained before checkout is completed.

4. Orders and contract formation

Placing an order constitutes an offer to purchase. The contract is formed when we confirm the order by email. We may reject an order for a stated reason, for example an obvious error, insufficient stock, an unverifiable payment or a delivery restriction. Any amount already received will then be refunded.

5. Payment

Payment is made using a method offered at checkout. Processing may begin once payment has been received or authorised. The product remains our property until the full amount due has been paid.

6. Delivery

We deliver to the address provided with the order. Availability, estimated delivery time and shipping costs are stated on the product page or during checkout. Unless another period is agreed, we deliver to consumers no later than 30 days after the contract is concluded.

We will inform the customer of delays. For consumers, the risk of loss or damage passes when the customer, or a nominated third party other than the carrier, receives the product.

7. Inspection, installation and use

Please inspect the shipment on receipt and report damage, an incorrect product or a missing part as soon as possible to info@variocook.com. Prompt reporting helps us resolve the issue and does not limit statutory rights.

Gas and electrical products must be installed in accordance with the supplied instructions, applicable standards and local regulations by an authorised or qualified professional. The customer is responsible for correct measurements, connections, ventilation and suitability of the installation site. Use contrary to instructions or regulations may affect safety and warranty without limiting statutory rights.

8. Right of withdrawal and returns

Consumers buying at a distance generally have a 14-day cooling-off period beginning the day after receipt. The procedure, exceptions, return costs and refunds are set out in our Refund Policy. The right of withdrawal does not apply where a statutory exception applies, for example to non-prefabricated goods made to the consumer's personal specifications.

9. Conformity and warranty

A product must meet the reasonable expectations arising from the contract. Statutory conformity rights always apply and are not limited by any commercial manufacturer or product warranty. Where we state a commercial warranty, its terms apply in addition.

Defects can be reported to info@variocook.com with the order number, a clear description and, where possible, photos or video. Depending on the circumstances and statutory rights, we will offer repair, replacement, a price reduction or a refund.

10. Liability

To the extent permitted by law, we are not liable for damage caused by incorrect installation, use contrary to instructions, unauthorised modification or normal wear. Nothing in these terms excludes liability that cannot lawfully be excluded or mandatory consumer rights.

11. Intellectual property

All text, images, manuals, drawings, designs, trade names and other store content belong to Variocook or its licensors unless stated otherwise. Use for the user's own installation and kitchen-design services is permitted where indicated with a download. Other publication, reproduction or commercial reuse requires prior written consent.

12. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including transport disruption, natural disasters, war, strikes, government action or serious supplier disruption. We will inform the customer and seek a reasonable solution. Statutory cancellation and refund rights remain applicable.

13. Complaints

Send complaints to info@variocook.com with your name, order number and a clear description. We will acknowledge receipt and respond as soon as possible, normally within 14 days. Consumers may also use a competent out-of-court dispute resolution body where applicable.

14. Changes

We may amend these terms. The version in force when an order is placed remains applicable to that order. The current version is available on this website.

15. Governing law

Dutch law applies. For consumers, this choice does not affect mandatory protections in the country of their habitual residence. Disputes are submitted to the competent court.
